These Terms of Service ("Terms") govern your use of Gathr, a platform for organizing reunions and group events, operated by KLS Consulting LLC ("we," "us," or "our"). Gathr (planwithgather.com) is a product of KLS Consulting LLC. By creating an account or using the platform in any way, you agree to these Terms.
If you're using Gathr on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You must be at least 13 years old to use Gathr. By using the platform, you confirm that you meet this requirement. Gathr is currently available by invitation or organizer approval only — we are in beta.
Gathr uses magic links for authentication — we send a sign-in link to your email address. You are responsible for keeping access to your email account secure. If you believe your account has been compromised, contact us immediately at hello@planwithgather.com.
You may not share your account or allow others to access it on your behalf. Each person must have their own account.

By using Gathr, you agree to receive transactional messages necessary to operate the service — sign-in links, invitations, RSVP confirmations, and event notifications. These are not marketing emails and cannot be opted out of while your account is active.
Gathr may also send you product updates and announcements. You can unsubscribe from these at any time using the link in the email.
SMS / text messages: Gathr does not currently send text messages. When we introduce SMS features, we will obtain separate consent and you will always be able to opt out by replying STOP.
You own the content you submit to Gathr — event details, member lists, messages, and other data. By submitting content, you grant Gathr a limited license to store, display, and transmit it as necessary to provide the service to you and your group.
You are responsible for ensuring you have the right to share any content you upload — including contact information for people you import to a roster. Do not import contacts without their knowledge and consent.
Our Privacy policy explains how we collect, use, and protect your information. It is part of these Terms.
Gathr is currently in beta. This means the platform is still evolving. Features may change, be removed, or be temporarily unavailable. We will do our best to notify you of significant changes, but we cannot guarantee any particular feature will remain available.
Beta users may occasionally be asked for feedback. Participation is voluntary.
We aim for high availability but do not guarantee uninterrupted access. We may take the service down for maintenance, updates, or in response to security incidents. We are not liable for downtime or data loss resulting from circumstances outside our control.
You may stop using Gathr at any time and request account deletion by emailing hello@planwithgather.com.
We may suspend or terminate your access if you violate these Terms, abuse the platform, or if we have reason to believe your use poses a legal or security risk. We will notify you when possible.
Gathr is provided "as is." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
In no event will Gathr be liable for indirect, incidental, special, or consequential damages arising from your use of the platform — including lost data, lost revenue, or reputational harm — even if we were advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of Gathr is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes will be resolved in the courts of Indiana.
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of Gathr after the effective date constitutes acceptance of the updated Terms.
